The Law is a Servant of Man’s Rights

“The idea that rights exist only when they are recognized by law is a misunderstanding of the nature of rights.”

— Ronald Dworkin

Correct. You have individual rights whether the government recognizes them or not.

The law is a servant of rights. In a free society — in a constitutional republic — rights are everything.

The institutions of government (courts, etc.) exist ONLY to uphold rights. The moment a law or agency of government violates rights, it loses all legitimacy.

If the government and its laws are to retain any legitimacy, it’s critical that the laws in violation of man’s rights be overturned or repealed.
